City wins one, loses one on appeals

NORTH BEND – The city recently came out on the winning and losing ends of two land-use appeals concerning property near North Bend, south of Interstate 90.
In a review of the two appeals about zoning changes for 164 acres of land owned by Richard and Rosanne Zemp adjacent to the Forster Woods subdivision and 80 acres owned by Robert Yerkes, King County Superior Court Judge J. Kathleen Learned sided with the Central Puget Sound Growth Management Hearings Board, which ruled on the zoning changes in November 2001.
The initial appeals date back to the 2000 King County comprehensive plan amendments that changed the zoning for the Zemps’ and Yerkes’ properties. Under the amendments, the Zemps’ land was upzoned from forestry to rural residential, or RA-10, one house every 10 acres. The zoning for Yerkes’ property was increased from RA-10 to RA-5.
