The King County Prosecutor’s Office has thrown out its marijuana-delivery case against former Snoqualmie resident Bryan C. Gabriel.

Gabriel, 28, had been charged last June with a violation of the Controlled Substance Act. Charging documents state that in June of 2009, Snoqualmie Police investigated what appeared to be an illegal drug deal in Covington between Gabriel and another man. Officers arrested Gabriel in July of that year for allegedly selling two pounds of marijuana in that transaction, according to court papers.

Charging documents say Gabriel told police that he had previously been supplying marijuana for medical purposes to 15 patients.

In March, a King County jury deadlocked in the case.

“With consideration to the jury’s decision and in the administration of justice, the state is moving to dismiss without prejudice,” Deputy Prosecutor Brian Wynne stated in the Tuesday, April 19, motion, which was approved by a county judge and signed by Gabriel’s attorney, Kurt Boehl.

Dismissal without prejudice allows for re-filing of the case in the future.

If he had been convicted, Gabriel would have faced a maximum of six months in jail.
