On Oct. 6, the Federal Energy Regulatory Commission notified Black Canyon Hydro, the sponsoring agency for the project, that it missed the Sept. 30 target it had set for submitting a final license application. The deadline was self-imposed; in the draft application submitted Dec. 1, 2015, Black Canyon Hydro estimated the final application would be submitted on before Sept. 30 of this year.

The Oct. 6 letter to Black Canyon Hydro also noted that the agency was notified Feb. 11 that its draft application was missing several pieces of information, and that information had still not been provided to FERC by the date of the letter.

David Turner, chief of FERC’s Northwest Division of Hydropower Licensing, wrote “To date, neither the final license application nor the outstanding study information has been filed, and your preliminary permit for this project expired on Sept. 30, 2016.”

Black Canyon Hydro has 10 days to submit a response detailing the progress made toward the development of a final license application since the draft submission last December. FERC requested that the response include a justification for missing the anticipated filing date of Sept. 30, and offer a new submission date along with a list of the steps Black Canyon Hydro will take to meet the new date.

“Failure to respond with a showing indicating progress is being made may result in the termination of the ILP (Integrated Licensing Process) for the Black Canyon Hydroelectric Project,” Turner wrote.

On Oct. 6, Chris Spens, licensing manager for Black Canyon Hydro, told the Record the company planned to respond to the FERC within the time given.

“We will be submitting a response to FERC within the next week,” Spens said.
